Taking 10% more maintenance from tenants and owners of empty flat. Is this ok?

    I am not in India right now and thats the reason I have really no say over whatever the society charges me for whatever silly reasons they give.

    They say there was an incident where a falt was empty and onwers lived in B’lore and thr was a gas leakage in the flast for which they has to call police and break door etc etc.

    So all the empty flat owner have to pay 10% more maintenance. 1400/- pm for onwers and 1550/- pm for tenants/empty flats owners.

    I fail to understand
    1> if a tenant uses my flat how does he/she benefits anyways to give extra 10% maintenance
    2> Empty flat owner are anyways baring loses for not renting and paying more maintenance.

    I feel the burn from here coz for that empty flat I have to pay EMI of 20K, Maintenance of 1550 pm and Property tax

    Maintenance is calculated by each unit availalble in society.

    In Mumbai its fair norm to pay 1/- per sqft pm…this is an example.

    I feel a 3BHK owner should pay more maintenance that a 2 BHK owner/Row house owner.

  2. Dear Muthu, If some body wants to challenge the bye laws, it can be done in the court of law. How much one is ready to take pain is individual’s choice.

    there are laws of the land and “bye-laws” of the society? do bye-laws super-cede the “laws of land”. somebody could be renting out property and renting a smaller and much cheaper place to obtain the differential for his living. asking for extra maintenance is not fair. With the same logic, maybe there should be a maintenance per head and each household has to pay depending on the heads staying there.

  4. Dear Priyanka, it ‘lll depend upon the exact bye laws of your society. If there is such a provision you w’d have to pay more. FYI – for one of my rented property, I’m paying extra maint. amount. The logic for this extra amount given to me by my society, for day to day affairs, the tenants or empty flat owners are not taking any interest as well as efforts. Also in case of tenants, the flat owner is earning an income whereas normal flat owners are living in their own flats.
