PF Claim Regarding

Dear Sir,

I am presently working in a private firm in Tumkur, Karnataka. The Employer deducted the PF amount from the employees’ but not remitted to the Dept. from past 1 year. The employees’ who had left the company in the past 6 months had applied for claim of PF amount but the claim form has been rejected and has been sent to Company asking the company to produce the previous year PF paid challan and return. The employees’ who’s claim form has got rejected are asking that “If the company has not remitted the amount, it is not our falt. PF organization should pay us and get that amount from the employer”. Hence I want to know, is there any chance for me to get information through RTI about how the PF office acts under the above situation & how it performs and what the PF act says for it.

    Dear Ashal,

    Thanks for the suggestion. I had written letter to EPFO seeking information under RTI act 2005. My friends who’s claim form has got rejected due to non-payment of PF amount by the employer, they are telling that “Let EPFO pay us as per the 3A for attached along with the Claim for (19 & 10C) and let them collect the default amount from the Employer. Why they (EPFO) should punish us by non-paying our amount”.

    I am waiting for the reply from EPFO. I will let you know the answer given by EPFO.

  2. Dear Mahesh, in the given case, PF department is not at fault. Actually it’s the cheating by your employer for which your employer should be made responsible & not the PF department. RTI is of no use in this case. As the money is not deposited with PF office, how can it returned it?

      Thanks Mr. Ashal. I am not saying that the PF department is at fault. I know it is the fault of the employer. I want to know through RTI that, what course of action will be taken by PF department under such circumstances. I also want to know what does PF act says for such cases.

      1. Dear Mahesh, you may file RTI for it to know the details & course of action from EPFO. In my personal view, filing a criminal case of forgery & cheating against your employer is the only option with you & your friends.
