What is the meaning if noted in Sale deed of joint ownership property of spouse as ………….’ VENDEE ‘ (which expression shall mean and include their heirs,successors,legal representatives and assigns respective )……………………………….VENDEE are spouse……………in death case of a husband/wife surviving spouse will be legal heir as per terms mentioned above or not ? If husband dies wife will be legal heir if husband has mother & no will available ?

Dear Vijay, in case of joint ownership, if there is no will of the husband, the mother ‘ll also become heir & her share ‘ll also be there along with the wife & children of husband. Here I’m giving an example. There are mother, wife & 2 kids in the family after the death of the husband. The shares of each individual ‘ll be as below –
Wife – 50% from her own share + 12.5% from husband = 62.5%
mother – 12.5% from husband’s share
kid one – 12.5% from husband’s share
kid two – 12.5% from husband’s share
