About post dated cheques

Hi 

Actually I need to ask about how safe is a post dated cheque. I am a tenat and my flat owner is asking for rent in form of post dated cheques. So is it safe. What if he encashes it before the due date mentioned. I searched net and found many such cases. So need to just seek your kind advice on the same. Personally I am a bit jittery about these post dated cheques and have also heard that RBI has issued a circular to do away with PDC system. Please advice.

    Dear Kaushal,

    The landlord must be asking for PDCs to keep himself safe in case you default / delay in paying rent. One of my known also had to deposit PDCs with his landlord.

    He can not deposit the cheque before the due date (date mentioned on the cheque) as it will not be cleared before the date ad may even be returned to him.

    In case you have to give PDCs, make all the cheques Account Payee, keep a record of all the cheque issued and their dates. Also you may get the same included in your rent agreement that you have issued PDCs as rent to the landlord and in case any of you choose to cancel the agreement in between, all the PDCs shall be returned to you.
